Bankruptcy &c Copied.
This determination being taken, the prefixing the shorter paper
to the larger one presented itself as to measure that in the character of the next
was a measure that presented itself as being more conducive to that end
presented itself as a sort of preparatory measure that might
be conducive to that end the end in view.
As to the part measure more particularly here
in
question, – to cause from first to last, to cause see the Bill to
be thrown out has never formed any part of my wishes.
Two operations were necessary to the success of it the measure
introduced by any noble friend – the putting an end to the
existing state of things in relation to this subject part of
the judicial establishment with its procedure, and the introduction birth of a new
one: in relation to the first, my wishes were all along in
entire accordance with his, of his in relation to those of my noble friend: in the other where
consistent the difference.

Throughout the whole course of my labours, once
rule has been without with adherence, been observed conformed
to by victim⊞ ⊞ be the institution
what it might, never to engage in
any such attempt
as that of pulling it
down, but for the
purpose and with the never to set myself not to attempt to pull down any thing institution,
without the , to raise up something that, to me, seemed better,
in the room of it: of the observance of this rule eviction will
exemplification will, on the present occasion be seen, under the head of Amendments.
The smallness of the type had for its cause
the intention of be making use of the letter post for the
conveyance of the this tract: little did I then think of the lengths to
which it was destined to be drawn out.
Things left undone that ought to have been done, to those two
hands will be found referable the charges, here made against
the measure the institution, the effects of which are now
beginning to shew themselves: among the things left
undone, consignment of the consignment be one and the same
judicatory, the business performed by the Court called the
Bankruptcy Court and the Court called the Insolvency Court,
that is to say under the Judiciary Establishment as at present
constituted, with its system of Procedure: for under the
system of which
I have ventured to propose,
suits of all sorts
without any exceptions
worth particularizing would
be taken cognizance of by
one and the same a set of single-seated judicatories,
proceeding according
to the same simple, natural, untechnical, quasi-domestic system of procedure. In the publication intituled Petitions for Justice and Codification may
be seen a slight sketch of it.⊞2
⊞2 As to the things
which in my view
motion of the matter
ought not to have
been done, to hold
up to view a part
of them, nor yet
more than a part of
them, is the business
of the ensuing pages.
