as to other offices

such as promise the
continuance of the
highest degree of aptitude
in the official
person (as mode of
appointment should
secure it on entrance
into office) regard
being had to existing

of an office becomes
unfit to such a degree
as to outbalance the
evils of change, he
should be removed,
and a successor appointed.

3 In case of a non-established
Church, the
assurance that the
course taken gives
the fairest promise
of proceeding in the
best manner for the
accomplishment of
the ends of the office,
has been shewn to be
at its' maximum.
The instructor continuing
to render
his services to his
pupil, not longer
than the pupil supposes
him to possess
the highest degree
of aptitude of any
whose services are

4 Such removal
either by the act of
a majority, or by gradual
recession, is
incompatible with
an established church
as above explained,
with the right of
patronage where
it exists. p.3

cases which suppose
the highest degrees
of inaptitude, ex. gr.
extinction, partial
or total, of the qualifying
endowments,
hence the necessity
of a judicatory
to ascertain the existence
of causes of removal.

efficient right
of patronage as they
might might prevent
him from securing
the benefit to the
person he had the
best opinion of.

being given,

whether the inaptitude
existed at the
time of appointment,
or was brought into
existence afterwards.

Ergo the judicatory
which decides on fitness
of appointment
is the best to decide
on propriety of removal.

7. An objection to
this arrangement
may however be
here brought to view,
viz that in the proposed
judicatory,
the judge's partiality
for his own choices
may lead him to
continue an unfit
incumbent. p.5
