§.4. Post-reformation

1
As to removal by Bishops,
In the intermediate
state above described,
the Reformation
found the Parish Priest.
The alternative undisguised
despot is in or do
disguised under the
forms of judicature in
which the will of the
Bishop was declared
by his subordinate
in the habit of a Judge.

2
So when in case of the
King (H.8.) the question
was, whether he should
be judged by his own
Archbishop in England,
or the Cardinals at
Rome under the Emperor's
influence — Who
in either case could
doubt the result?
p.1

3
Such, especially in a rude
age, is secret Judicature
under do influence. p.1

§.5. Practice Anglicé

1
After the Reformation,
this state must shortly
have fixed itself at
it's present less flagrant
inaptitude. p.1.

2
Removal — not without
judicature. Judge
Bishop's Chancellor, named
by the Bishop
but not removable
by him or his succesors.
— Judicature technical,
Rome-bred,
fee-gathering, the object
uncertainty, delay, vexation
expence — the practical
effect. p.1

3
Under this sort of discipline
there no offence except
determinate punishable
ones, (nor even all of those)
with which a man may
not be chargeable and
yet go unremoved. p.2

4
At the head, place, complete
neglect of duty
from a mans on the
trust to his death.
Anglicé transgression
of this sort, viz. determination
not to bestow
a moment of time on
the duty for which
he is lavishly paid, is
never pretended to be a
cause of removal; else,
pluralities and sinecures
could not exist under
it. p.2

5
As total non-fulfilment
of duty does not
produce removal, useless
to enquire whether
partial defect in quality
or quantity does. p.2.

6
Suppose any such transgression
notorious, what
chance is there of deprivation
following — As under
the technical sytem, deprivation
cannot take place,
without prosecutor. But
under this system, what
can induce a parishioner
to take on himself this
invidious function. —
Before he even take his
chance for punishing
this wrong doer, he must
punish himself — Like
the story of the Japanese
who rips open his own belly
to make his adversary do
the same. p.3.

7
To take upon a mans shoulders
so indefinite a burthen,
when least, so much
beyond the ability of the
great bulk of the people
to bear, what can afford
a man sufficient motive?
Answer — Possession of
the next presentation if
the incumbent be not
connected with him. p.4

8
Every Market day at Smithfield,
wives sold and
bought — This when consummated
is adultery
and punishable as such
in the Bishop's court.
Were any such report
heard by the Bishop,
would he think it worth
mentioning to his subordinate.
p.4

9
Were one of the sinners
an incumbent on a living
of which the presentation
was in his Lordships gift,
then the sin might be
worth punishing. p.4

10
Divines who find profit
in their own wife, and
pleasure in another man's
do not take Smithfield
to witness. p.5.

11
Sincerity an offence
much more sure of drawing
down punishment.
After having set his hand
to the string of absurdities
composed to try at what
height the allurement
of opulence might bring
insincerity, he were to
repent, this would be an
offence indeed: — he would
be cast out with disgrace,
and the establishment
cleared of troublesome &
misplaced sincerity. p.5
