4. Another ground plea is that this offence was the first.
A man not having been convicted of prosecuted for more offences
than one a reason for not punishing him for that one!
When under the maxims avowed and acted upon by Mr Vansittart
no smuggler or other offender whatever would
though offending every day of his life would
ever be convicted of suffer for so much as one offence without
a miracle. When Without a miracle no man though offending every day of his life can
be convicted of so much as one offence, and here is
Mr Vansittart who insists that when he is disposed
to give impunity no man shall be punished for any
one offence unless and untill he has been convicted of some
number — and he leaves to be imagined does not say what number — more
than one
