Another collateral consideration is — that while the
Treasury Board i.e. the Minister has such a power, is whether corruption
be or be not among in the number of his intentions or his motives
it corruption can not fail of being of in the number of its effects
By the supposition, in whether the whatsoever in respect
of party be the conduct of a delinquent favourable obsequious to the
wishes of the Minister, adverse to them, or neutral, by the supposition
the Minister being by the supposition a man of heroic
virtue no impunity or undue indulgence whatever much less
any such thing indulgence or impunity will the delinquent exert experience
with at his hands. True: but by the supposition the heroic virtue exists,
but the delinquents how are they to know of it?
what reason have they for any such supposition as that
of its existence? what for the obtainment or so
much as the continuance of such a power — a power
which to hands so situated it is altogether easy to use
improperly but not possible to use properly — a power
which is never intended to be can be exercised but upon
evidence given in a shape in which when evidence is
to be had in any better shape it is acknowledged to
not to have any claim to evidence — what makes
what inducement can a Minister have but the intention
of putting it to that sort of bad and corrupt use
to which alone it is capable of being applied?
