1829. June 7th. Art. on Utilitarianism

Further explanatn. herein above below as also in the
article on Mr. Humphrey's work on Real Property
in No of this Review. Not that without some modification
received from two other sources this subordinate
principle can consistently with the dictates of
its superordinate the greatt. happss. prine. be employed
to determine the expressn given to all the arrangements
belonging to this branch of the all-comprehensive
rule of action : but to make any further
advance into this field wd be to diverge too widely
from the track properly belonging to this article.

53.
In the penal branch
a different aspect. Object
minimization of
wrongs. Remedies classed
under 4 heads by J.B.
preventive, suppressive
satifactive & punitive.

So much for the civil, now for the penal,
branch of justice. Here the rules by which expressn.
is given to
in general terms indicatn.
is undertaken to be given of the subordinate
ends to be in view. In the arrangemts. belonging
to this branch of the view of law a very
different aspect & do not suggest the idea
of any explicit correspondency. The penal branch
of law having for its peculiar end in view the
minimizatn. of the aggregate of wrongs & there is
in so far of the sources of unhappiness : such remedies
as present themselves as furnished by the nature
of things as being capable of being applied
with advantage, the reductn. of the number of
those wrongs, or of the quantity of sensible evil
producable by them have been by Mr. Bentham
classed under four heads; namely, the preventive,
the suppressive, the satisfactive,
& the punitive or say subsequentially preventive:
the punitive in consideration of
its effects on the of the alleged malefactor;
to whom applicatn. is made of it; the
subsequentially-preventive in consideration had
of & reference made to the benefit expected
to be done to the community by
keeping out of existence future contingent wrongs wrongs similar in
their nature to that on the occasion of
whh. similar to that in consideration of
whh. the manufacture in questn. is purposely
made to undergo the suffering this
created.
