Of Homicide,when of duelling,

Homicide what
Homicide has place in so far as one person is instrumental
in the production of the death of another.

Suicide x altericide
In so far as the person whose death is produced
is the person by whom it is produced, homicide is termed suicide.
In so far as it is any other person it may be termed altericide.

Homicide may be distinguished into justifiable, culpable,
and criminal.

Influencing circumstances by which the degree of
mischievousness& thence the demand for modes of repression
are influenced, are the following
First the intention, according as it is present or absent: and
where present according as it is directed exclusively, or indiscriminately
to the production of this effect.
2. The end in view.
3. The motive, by which the intention to kill was produced
or in ease of the absence of the relative intention,
the act by which the disastrous effect happened to be produced.
4. The occasion on which the act was performed.
5. Means, by or through which with or without the intention the effect was produced.
6. The situation in life of the party slainslayee
7. The situation in life of the slayer.
