1825. Aug t 23. Penal Code
Note Note 5 End in view & intention everywhere distinct
Note. a. End in view. Whene the intention is full and conclusive,
the end in view will coincide with the effect produced.
In some cases it will be altogether different.This
will depend upon the nature of the motive & the ocassion:
for instance where the motive is lope of money, the ocassion
the right of, prospect of, succession of the slayer to the property
of the slayee; the end in view will be the acquisition
of the property not the production of the death : so likewise
in the case of assassination for hire. In this case,
the intention will be exclusive not, as in the
case of an a affray or challenge, indiscriminate, in
which case, the result of the act, if any, may be
either death, or any inferior corporal injury vexation
