Penal Code

Ch I. Offences Pain

§§. 4. Homicide

II
Robbing Predatory homicide
1 without warning
2 after warning and
this 1 without 2 in consequence
of neither

Of predatory homicide the most frequently exemplified
modification is that which has place where the act
is performed in prosecution of a design of robbery i.e procuring
of money or money's worth by physical force or fear of immediate
injury damage to person or property. For the several modifications
of robbery see Ch. Robbery.

In the case of predatory homicide distinguished between
robberyhomicide without warning&robberyhomicide after warning
&in the case of homicide after warning between homicide
without resistance&homicide in consequence of resistance.

The demand for these distinctions is created by the
difference between the demand for punishment in these
same cases. See means of repression or repressives § Compensation & Punishment.
