Ch III. Offences vs Person & Rep
§ 3. Challenging.
In other words the property of the slayer may
in such proportions as accordingly to the circumstances
of the case may to the judge seem
meet, be divided between the slayer those
who would be his natural representatives
had he been slain, and the representatives
of the slayee.
Art. 4. On this occasion, if the slayee has left
a testamentary disposition, such disposition
may be taken for the measure of the compensation
money awarded at the charge of the slayer,
as above.
Art 5. If while the challengee has, in the
or in consequence course of the contest; sustained corporal vexation
in one shape, as above, the slayer has sustained
corporal vexation in another shape as
above, the damages on side may, in the
way of a set off be deducted from the damage
in the other.
Art 6. Compensation being as above governed
by, and proportioned to the effects the evil
effect produced, the punishment will be governed
by and proportioned to the intention
If for example, from the circumstances of the
case, it be apparent that nothing but the death
of the antagonist could have satisfied the design
of the challenger, the punishment will be
that which, in the case in question, is attached
to exclusively intentional homicide.
