Penal Code

Ch. III. Offences—Person & Repu.

Art 1. Every person, by whom a challenge (or what
shall be deemed such,) is received is bound to give information
of it, in person if possible, to the Judge, at the
Judicatory.

Art 2. To receive such information all ordinary
proceedings then carrying on in the judicatory, are stayed.

Art 3. On receipt of such information, after sufficient
examinations of the informant, the judge either dismisses
the information, or retains it.

Art 4. He will not dismiss it unless he be fully
persuaded that no challenge nor menace nor insult,
direct or indirect, were intended.

Art 5. If he retains it, he issues as the exigency of
the case may appear to him to require, for compelling
the appearance of the challenger or supposed challenger,
a pretension mandate, on an accersition mandate.

Art 7. Of the day and hour so appointed for appearance,
he gives notice to the informant, and at the same
time he delivers to him an accersition mandate, ordering his appearance also.

Art 8. In case of need, especially in case of suspicion
of falsity on the part of the information for the purpose
of vexation, he may commit the informant to safe custody,
subject to relaxation on finding adequate security,
at that same time, or at any intermediate time, antecedent
to the time appointed for the judicial meeting
as aforesaid.
