Code little difficulty in
ascertaining degree of
mischievousness of cause
ofchallenge or prove its
By means of the mutual judicialappearance and
examination established in the Procedure Code in
this as in all other cases, there will be little difficulty
in bringing to light those circumstances on
which the degree of mischievousness and thence of
guilt, depends: whether, for example, the challenge had
it's cause a sudden and unexpected quarrel, or
any of those remote signs of triumph over rival
or other adversary, or of self advancement in one
shape or other, by the deaths of the challengee.
