No intention as the
diversity in mischievousness
of the several species
of homicide
Seen already have been the distinctions
in the point of substantial mischievousness, which
really have place among the many offences, forced
together on this occasion, in virtue of their presenting
in common one and the same physical
effect on that part of one individual,
extinction of life. The diversity prodigious as it
is between the effects produced in by these different
cases upon society at large not having attracted
the attention of the ruling few, in the early and uninformed
times in which the foundations of this
branch of the law were laid.

Entire omission of
satisfactive
result
Seen at the same time have been the
different repressive remedies proposed to be employed
in consideration of those same differential
circumstances. If these remedies are opposite,
proportionally, in the above several cases,
must be inapposite beneficacious the arrangements of law in
it's actual state. In particular, the proposed
arrangement by which the matter of satisfaction
to the relatives of the deceased for the loss sustained
by them, is employed in the character of punishment
in preference to every thing that goes commonly
under the name of punishment, to every thing,
in the designation of which the word punishment
is commonly employed ofthis must powerfully universally and unquestionably operating repressive, the use
has in every case been omitted.
