1. Homicidal challenge. Mode of proceeding for the
party challenged. If you are in doubt whether
the intimation received was or was not
intended to operate as a challenge, for
clearing up the doubt, make your application address yourself
either to the supposed challenger or to the
judge as you see best, according to circumstances.
If the supposed challenger
is near at hand, and you see no reason
to expect at his hands evasion in respect of
answering, or purposed delay, the best
course will, in general, be to address
yourself for this purpose to the supposed
challenger; but in this case, your application
whould be in writing: if it be by
word of mouth, misconception will be liable
to have place; or if he is insincere or forgetful,
he may hold himself not bound
by what is past, and the evil, instead
of being put an end to may be aggravated.

2. If the supposed delinquent be at
a distance, or evasion be suspected, to
the end that the idea of the challenge may remain hanging over your head; let your application be to the judge at once
