§ Challenging 6 Mode of preceding
by judge after
challengees application

The judge will then, by a pre-hension
or acercision or summontion mandate as he
sees best, cause the supposed delinquent
to meet you in the justice chamber, in
the judges presence, face to face. At the
meeting, on being examined by yourself
or by the judge, according to the direction
of the judge, the supposed delinquent,
thus become defendant, you being pursuer
will either deny or confess the intent
to challenge. If he denies, the judge,
after eliciting such evidence as the case
happens to furnish will either acquit
or convict him of the charge. If acquittal
be the result, the judge, if he convicts
you of temerity, in your accusation
will ordain at your
charge such satisfaction costs included or punishment
as to him shall appear fit. In case of
delinquents the supposed challengers conviction, he will ascertain
in like manner either the challenge be
retracted or persisted in. If retracted, he
will pass sentence for the past offence only; if persisted in for the
past, as also for the present and aggravated offence.
