Causes of the prevalence of this evil

1. Primary cause: the rude state of publick
minds and manners in the early
ages, as above.

2 Secondary case
rude state of legislation
& judicature

2. Secondary cause: the rude state
of legislation and judicature. over
a large extent in the field of delinquency,
the object of legislature, such as it was,
or rather, of the course pursued by the
sovereign, in lieu of legislature, not so
much the repression as the increase of crime.
Forfeiture, so far as it was worth applying
- forfeiture, that is to say, transfer
of the property of the supposed delinquent
to the use of the sovereign or his assigns
was the harvest looked to ruling object of endeavour:
and no pretence that could
serve for gathering it in was left unemployed;
hence it was that in cases, to
so vast an extent the property that should
have been applied in the first instance
for the purpose of affording compensation to the individual
wronged, or in case of his decease, to his representatives, was
swept into the coffers of the sovereign, an application. by
which no such emotion as dissatisfaction appears to have been
produced in the breast of Blackstone.
