of proposed system
1 By satisfaction
Prospect of efficiency. 1: From the arrangement,
by which in case of death, the
property of the slayer is taken from him and according to circumstances
if he has no dependants by nature
or adoption, transferred to the like dependants on
the part of the slayee in this case, we see
the penalty is of the pecuniary kind,
and thus far of no other. Now, in familiar
practice a penalty in the same shape &
to an amount in any degree inferior is
found almost invariably to have the effect
desired, when one man threatens corporal
vexation injury to another, the menacee
has recourse to a judicatory, and the judicatory,
after summoning and hearing the
menacer advises him to find security,
commonly with two bondsmen, this security
finding consists in entering into an
engagement with the judicatory to pay
a certain sum, and the two bondsmen,
each of them half the sum, in the event
of his inflicting or seeking to inflict
on the menacee, any such injury within a time limited.
After an engagement of this kind entered into security can
any instance of a repitition of the wrong be found.
