Penal Code

Ch III Offences - Person & Rep
§3 Challenging

§ Accessories who

challenger.

A part of accessory offence - a mode
of complicity - may in this case be constituted
by a third person speaking to or of
the challengee in a tone of contempt on
account of his non-acceptance of the challenge.
The means of repression, which, in the principal
case, have been seen to afford so
fair a promise of efficiency, may surely
be regarded as affording, if there be any
difference, a still fairer promise in the
present case. The third person, not
having any quarrel with the challengee,
the fear of a much slighter
inconvenience will suffice to overbalance
any gratification he could promise
himself from an aggression thus
wanton and unprovoked.
