§ 3 Challenging

But if this alleviation of the punishment
has place, care should be taken, that in
formation of the difference between what
was intended and what ensued, should,
if possible, be made known to all, by whom
the species of the offence and the quality
of the affliction actually sustained has
been made known: lest otherwise, the
punishment should appear to fall short of the
quantity, suitable to the offence.
