Penal Code

Had ever a substantive branch of the
law, been in this case, ever so favourable
to justice, the state of the adjective branch
was and is still such, as to leave render it, nearly
if not altogether, inefficient. The application
of the remedy necessitates as has been
seen the meetings of the parties face to
face, in the presence of the judge, with
free and mutual interrogation and counter
interrogation; not to this mode of procedure
in this case as in all others a preemptory
bar stands opposed, by the original and
still continued end in view of the actual
system of judicature, that is to say, emolument
of lawyers, official and professional
at the expense of justice
