Ch. or §. Challenging to fight with deadly weapon
Challenging to fight with deadly weapon is a
misdeed of a very highly anomalous nature.
It presents itself to a first view as an act of preparation
with reference to homicide: and such it is accordingly in effect.
It differs however from an ordinary other act of preparation
in several various material respects.
In the case of on like score is
1. It is an act of preparation not with reference to
death alone but to the several other afflictive results short
of death, any one of which is nearly upon a level with death
on the scale of probability. These are disablement curable and
incurable, disfigurement curable and incurable, mortification
curable and incurable, mutilation curable and incurable.
2. In other cases if the act of preparation becomes
known to the individual in whose case at whose charge the evil is intended designed
in a t its consumate state is designed to be produced
the act of consummation is thereby prevented. Not so in the present
case.
3. In other case, wrongful constraint and wrongful restraint
including wrongful confinement and wrongful banishment excepted, in the cases in which they are respectively produced
by intimidation – itself an offence affecting the mind.
4. In no other cases, the act of consummation can never
does the consent of the party suffering precede or accompany
or precede the consummation of the deed act from which may the evil mischief flows.
