1826. July 21. Penal Code Duelling extinguishable
(3.)

Ch.
§
7
But Insulter's relations
would not be voluntary
witnesses of such punishment,
to Insultee's relations on the
other hand such retaliation
would be a welcome spectacle
and they would attend without compulsion.

Under this head however it should be
considered that, naturally speaking, persons
thus connected with the Insulter would not
naturally with their own consent be percipient
witnesses of this humiliation: and that
to compel them would be to subject to
punishment persons relatively blameless:
whereas, on the other hand, to the relatives of
the Insultee an exhibition of this sort
would naturally be a welcome spectacle,
the humiliation of the Insulter being the
triumph of their relative. Invitation,
therefore, without compulsion, will generally
speaking in their instance be sufficient.

Means of securing
compliance with a
Presence Banishment
decree

Means of securing compliance with
the Decree for Presence banishment.
These will depend upon the effective responsibility
of the convicted Defendant, relation
had to the purpose for which
the burthensome obligation is imposed.
