Penal Code Ch. Offences affecting person
Ch or §. Challenging to mortal combat

Ch. or § Challenging – to fight with mental weapon

Challenging – the practice is a remnant of antient antique
barbarism. On any particular belonging to it, it is of a highly most
complex natur texture: the the nature of it more to
ere any tolerably adequate be obtained with in the
first place of the nature of the disorder, consequently is in
the next place of the best adapted remedy.

In the first place it belongs to two classes of offence
at once: the self-regarding, and an extra-regarding
class. What the object of the challenge with a declaration
of the life or deterioration in some way or other of the bodily
frame of the challenger: of the person to whom by the he
he renders himself an adversary, this is the extra-regarding
offence; and for the obtainment of the gratification expected
from the result of the act of which these are the probable
consequences he is not only called but desirous to
expose himself and in an equal degree to suffering in both or
all those shapes.

Upon the face of this statement, here is a person an offender
who creates in his own person the two characters of an enemy a murderer
to another person and an enemy to himself: and in both characters
he is a mortal enemy. In the a character of his own
enemy, the character frame of mind he is that of a fool: as the
in the character of one whose endeavour it is to inflict upon
his fellow men a mortal injury his character is that of
the ruffian: the ruffian and the fool in such sort combined
that the malefactor compounded of the two has in some
other person more than he has himself.

Such is in all cases the superficial complexion of the
cases, but when naturally looked into are analysed, the result of the
analysis brought to view no small number of diversifications or even
species of disorder, by
which so many different
modes of are
requisite.
