Ambulatory presence

Ambulatory . Ambulatory presence banishment
is where either by and in compliance and conformity with a mandate declared on the part of
the banishee or some person of his appointment the banishee
is laid under an obligation of absenting himself or departing from
or out of a place therein mentioned for at and during certain portions
of time one or more therein for that purpose mentioned.

Banisher either wrongee
or any other person
The mandate may be so worded as that at
and during the space of time therein mentioned the banisher
may in the person of the wrongee or every person one or
more by the Judge or by the banisher mentioned in the place
or places mentioned the banisher shall be under the obligation
to guard the place in ques or places of which for that purpose
a correct designation and description will therein be given

Banishment absolute
or conditional
The banishment may in this case be either absolute
or conditional: conditional as for example where the obligation
of departure from the place in question has been made dependant
on the wrongee: the wronger thus by appointment fleeing from the presence of
the wrongee was a convicted criminal delinquent whose desire and endeavour is how
to avoid being prehended would on that account endeavour to place
himself and keep himself out of the road of the wrong functionary
to whom a mandate for his prehension had been addressed.
