Penal Code
Ch. Homicide
§. Duelling
This Shield bearer, it appears, served in foot:
scutifer, an appellative now melted down to an
Esquire, served it is plain on foot: for eques
horsemen, was the peculiar and contradistinctive
appellation of the Military Lobster, whose Teutonic
name was Cnecht, in modern orthography,
Knight.
The time not spent in war was spent
by these exalted personages in preparations for war
and gymnastic exercises having for their object
or end in view the maximizinng of men's aptitude
for war. In trials of strength and skill between
man and man, opposed to each other, armed and
equipped exactly in the same manner, and in
pairs to the number of which there were no limits
other than those which were opposed by the difficulty
of bringing together in one place an adequate
quantity of the means of sustenance for
the party and its numerous and diversified train
of attendants. In modern warfare, the difference line between
actual service and exercise is drawn pretty
determinately by the absence or presence of the
bullet and the musket. In the one case, danger
extreme; in the other case none. In the practice
of chivalry, this line of demarcation was in some
countries almost evanescent: in the wars waged
with one another by the Italian Republics in the
Middle Ages, instances are recorded, in which battles
were won and lost without the loss of a man on
either side. Thus in a serious contention, while
in France and England, in the sport, the match,
the make believe, the theatrical exhibition, lines
would be lost on the part of combatants Gymnasts, exercising
in numbers not so great as those engaged in the reality
of the like warfare.
