Acts and practices which are in their tendency productive of danger of death
or other corporal vexation, remediable or irremediable, and
in relation to which chance of destruction and demarcation
require to be chosen between what is criminal and
what is culpable, and between what is no more than culpable
and what is blameless

Case demanding preventive regulations
These cases, many of them, will be said to produce
a demand for repetition having for their object or end in
view the removing altogether, or lessening the amount of the
danger improbabilizing in use by the lessening the rules expressive
of the degree of its probability
