2 §§ transgressing recapitulated
4. Common Law transgressed viz. in respect of that part
of it which concerns judicial procedure. Divers Delinquents virtually
pardoned by those to who it belonged to exact
divers fines imposed upon them according to law. The
fact stated by Sheriff Sir Richard Phillips as probable believed by being rendered probable to
him — by such evidence as had come within his knowledge.
The fact therefore not yet ascertained but either and by the circumstance of its remaining uncontradicted by all those to
whom if not true it concerned in part of reputation to
have contradicted it. The part therefore calling for inquiry's
the transgressors therefore not capable of being as yet exactly
ascertained, but if the fact of transgressor be found true capable of being
ascertained.
