C Preface

Thus far then the nature of the work may
be explained by the it's analogy resemblanceto others
already known: but what has been mentioned
though the ultimate and to appearance the
most efficient is by no means the whole,
nor perhaps even the principal part of it.
It has two other parts: one of which in the very
design of it and the other in the execution will
I believe be found to bear but little resemblance
to any thing that has yet appeared.
To the t tenor of the law are subjoined under
every title a view of the reasons on which
the several provisions that may be distinguished
in itare grounded: and to the whole in form of
an Introduction is prefixed a display of
the more general and fundamental principles upon from which those reasons
are derived.

I hereby offer to the public, the first book
of this kind, that I believe was ever offer'd to it,
a detailed and extensive body of law, is of a matter not but for proposed for law I should rather say of that sort of matter which if it had the sanction of authority would be termed law If such I may call term it for a moment, the work
of a private uncommissioned individual. When
In calling it law, I know I am guilty of
an inaccuracy, indeed of a contradiction, in
the very outset: but for this there was no help:
for when the the thing itself is new, no wonder there should
be no name to call it by. It is not I do not mean
a compilation; it is not any thing which purports
to exhibit what is any where established
for law by the sanction of authority: if it
were there certainly could be no pretense for
speaking of it as a new species of composition.
It is an original work, which iscertainly not law, because
it wants that the sanction of authority authoritative sanction, which
is constitutes the essential characteristic of that sort of composition
which is properly termed law. It is
not a body of natural law, nor any part of
such body: for in natural law of which we
hear such frequent mention I can see nothing but
