Of Principles adverse Principle of Vengeance Antipathy Principle of antipathy erring on the side of lenity - instance, the aversion to aggravated capital punishments

Another fruit of the principle principle
is the unwillingness to add any punishment though
it be for a fresh offence to the punishment of
death. Among a humane and placable people
simple death is sufficient to satiate in every case the appetite
of vengeance; and for the every purpose of particular prevention,
simple death which by effectually disables disabling
the malefactor from all future mischief subsequent to execution, is obviously
sufficient. But the end of general prevention
is of infinitely more importance than that of particular,
and even with regard to particular
there is an interval between the commission of
the first capital offence and the time of event which
perhaps may never take place of the inimicals being apprehended,
during which society requires to be guarded against him at least as much as during
any other: nor ought any crime to be left
without a motive to combat it.


Supra The principle of vengeance gives birth to various
instances of prejudice and erroneous practice. These
errors one would imagine at first sight, would be
all on the side of severity. On examination however
they will be found to be many if not most of them
on the side of lenity. A culprit is an object of compassion
