That the imperfect sort of knowledge which can
be gained of the law in its present confused
state, is a monopoly which is established in their
favour, and which for this reason therefore they have no
wish to break.
The truth is take it all together it is not yet in a condition to be
known. The business is to put it into such a
condition. To t do this it must be digested
by authority: the Common Law must be
digested into Statute. The petitions must be
substantiated into real. To do thus, the elements
of it, the scattered fragments, must be assembled; assembled assembled
they must be made communicated the memorials
of Judicial transactions must be published.
Either all the must be published that can
be found; or those that are not published
must be cried down. Whatever is to make Law
should be brought to light: or that which is not
brought to light should no longer be suffered to
make Law. With respect to many and many such
as memorial are remnant of ambiguity, it matters not
perhaps whether it be burnt or brought to light.
