clause.
there are two ways of expressing an idea In the case in question, the State of the Legislators
mind admitts of three four cases all equally any of them
unexposable.
Either 1st He overlooked the repealing clause
itself or
2dly He overlooked the effects of a re thought nothing of every such effect from
the repealing of it – or
clause and having in
contemplation such effect from the repeal if it
be and intending it should take place, he meant
to take this method of expressing such intention
that this being the part that that which occurred to him before
any other, or
4thly and lastly, intending such effect should
take place, he took this method of expressing such
intention, having compared it with the other direct one
and given it the preference.
Thus it seems to me, that either of the two first
suppositions is more probable than either of the
two latter.
When there are two ways of expressing the same
thing one – unambiguous, that is calculated to express
that and nothing else, the other ambiguous, that is
calculated to express somewhat else as well as that, it
is of our to advantage in every instance particular instance to use that only which it unambiguous:
