Equity 𝓧 the mode of judging, and the subject matter of the sort of
decisions taken together that are made in that Court
to which functions the exclusive function of that mode of judging was
originally appropriated.
He takes it up once and again returns to the charge
and shrinks from it after all, under shelter
of a word. His business parable is with Law
not Equity. As if the subject were less concerned
to know how is property is disposed of effectually
and in the lump by a thing called Equity, than ineffectually
and in parcels by a thing called Law.
I should be very glad to explain to my Fellow-Citizens
what this Equity is, one distinguishing characteristic
property of which is, to dispose in the lump
of mens properties estates that property, whereas of which the Law does only disposes
in parcels. Glad I say I should be to do this
and perhaps, tho' not in one the way of Episode, and
in a work book of these dimensions of this design upon this plan, I might attempt
