SECT. Interpretation. 10.

There are
business it is to interpret thus authoritatively
after the step has been taken , and in consequence
of the litigation that may ensue for it there are already, — I
mean the Judges [of the respective Courts.] What
are the difficulties in their doing the same thing
before the step taken and to save the litigation:
To save the ill consequences of unsuccessful litigation?
to save the re--surrender, for example of
an es purchased estate, after the purchase money
is dissipated and is irrecoverable? Is there no
remedy to those difficulties? If none are they
greater than advantages would be of such an
institution? Judges have shewngiven shewn a just
discountenance to collusive suits instituted to prejudge
the stranger's right of a stranger not present to
defend himself [a] — Do the reasons for such discountenance
hold with respect to questions submitted
by the parties themselves that are interested in an
act, submitted, I say, before that act is done? Our Author had he attended to a few questions such as these might have been less forwardlavish of his learning upon Rescripts: and less forward to decide upon a question which nothing called upon him to start. Learning is a good thing; but judgement is a better. Questions these which

been so forward to decide upon a matter he might
well have dispensed with himself from upon
