Civil Code
Civil Code – Subject matter of distribution are 1. Benefits.
2. Burthens. Benefits are – faculty so far as depends upon
right and obligation to put to their respective uses, and derive the correspondent enjoyment from, the several portions of
the matter of wealth and of the matter of property in its
several other shapes.
Location or say Ruling principle the disappointment-preventing principle.
Corresponding Rule. In respect of every portion of the matter
of property exception excepted keep ensure the faculty of putting it to its use to him
who is in possession of it: i:e: in him who in whose instance
if he were to cease to have the faculty of be in possession of putting it to its
appropriate uses, and thus doing whatsoever gratification is allowed
to be derived from the putting it accordingly to use, would
cease to possess that faculty the cessation would be productive
of the sensation of disappointment: and thereby of a certain painful
feeling distinguished by the appellation of pain of disappointment.
Of the institution of efficient causes of title to
portions of the matter of property the immediate object will generally
be the production of benefit.
Under the greatest happiness principle of the eff
institution of efficient causes of cessation of title to portions
of the matter of property the immediate object will
generally be imposition of burthen: but under the dictation of the greatest
happiness the ultimate object will in this as case
as in all others, the production of benefit – of benefit to an
amount preponderant over that of the burthen.
