For designating the matter contained in this Code the distinctive adjunct
Civil is here of necessity employed: of necessity because this
is the word by which legislative matter of thes nature in question
is in use to be designated; and because for the designation of matter
of this nature considered in the aggregate no other appellative
is in use to be employed.

It is however in a degree which can not be contemplated without
regret inapposite. In its original impart it expresses nothing
that is to the purpose: and it is in the habit of being employed
as applied to Law the adjunct Civil is in the habit of being employed
in various other senses from which the one here intended
requires to be distinguished.

1. It is put in opposition employed in contradistinction to Constitutional Law.
2. It is put in opposition to Penal Law.
3. It is put in opposition to Ecclesiastical Law: to wit to the aggregate
body of the law so denominated, including as well the Constitutional
Branch here in question viz the Constitutional branch and the
Penal branch:
4. It is put in opposition to Military Law: including the 3 branches
into which that same branch is divisible as above:
5. It is put in opposition to Roman Law: to wit to Rome sprung
Law including all the branches in which it is divisible as above
6. It is In Roman Law itself it is put in contradistinction to
that branch which is called Cannon Law: and on that occasion
is employed to designate all that is not understood to be designated
by the term Cannon Law. By the term Cannon Law is in use
to be designated of the whole mass of home spun law all that part which
be ecclesiastical matter of the subject
