Procedure Code Ch. Nomenclative Classification

Acts the objects indicated by this
nomenclature have place in every domestic tribunal

Compliance – non-compliance. Whether
for the purpose of interrogation or for whatsoever other purpose,
of every expression of will addressed to whatsoever person
addressed superi inferior, equal or superior on the part of such person either compliance
or non-compliance is the result. If he be
considered as a superior obedience and disobedience are the
words employed: if an equal or a superior, no correspondent
special denomination is to be found.

If it be a written dec Decrees. If it
be in the form of written discourse that the act of imperation
performed by the Judge is expressed, birth is given to
a correspondent judicial instrument called a decree,
a judicial decree. In the Constitutional Code Ch.
Judiciary collectively two decrees have were mentioned
as requiring to be constantly – the opinative
and the imperative – here we see is is seen the imperative.

Execution. If the act commanded by the
imperative decree be the rendering the exterior – the effective
service which the initiatory application has demanded at
the hands and at the charge of the individual compliance in this part is the result, effect is
at any rate given to the correspondent ordinance and
provision of substantive law, and executi execution in
one sense may be said to be given to it: though not executed
upon any person, by the person in question it may
be said to be executed, and thus far and in this case
and thus far we have no contestation – no defendant.

If non-compliance is the result, no such effect
is given or produced – it the ordinance is not executed by him, and upon him
if at all it remains to be executed.
