(2 §. Non pursuance of Notice

Notice contains either
benefit conferring or
the other imposing
Result of non pursuance
loss of the benefit or
incurring the penalty
of non compliance with
announced burthensome
obligation
Art. 3. The information contained in the instrument
of notice will have for its object either the accordance
of a beneficial more or less beneficial faculty, or the imposition
of a burthensome obligation more or less burthensome
of non-pursuance of a beneficial benefit confirming notice, the consequence
will be — loss of the benefit: of non-pursuance
of a burthen-imposing notice, the consequence
will be, incurring the penalty attached
to the non compliance with the announced obligation.

Of invidious notice
the blame of non-pursuance
attaches on him
at whose representative
it was issued.
Art. 4 Prima facie non-pursuance of notice
will be imputed to him to whom notice has been was
or was intended designed to be or was supposed to be designed
to be given. But what may be is — that on the
part of him by whom or at whose instance by the
Judge the notice was given or ordered to be given
the notice was insidious, that is to say in respect
of how or otherwise the act to be done in pursuance
of the notice was such as could not by the agent
in question be done in point of possibility, or
without great and preponderant inconvenience.
In this any such case the blame will be altogether
upon him at whose instance or upon whose representative this notice was
issued: if thorough rashness only, of his
responsibility will be compensational only; if with
evil consciousness, and thence through the result of
mendacity it will be compensational and punishment
