Heads of the Tothill Field Inclosure §.6.p.
Commissioners to be appointed
by the Parties to settle their
respective rights. —

Sect.6. Appointment of TwoThree Commissioners for liquidating the Rights
of the several Parties. — Dean and Chapter, [Rector of St. Johns,] United
Vestry and Feoffee, to name each of the, one. Power to Commissioners
or any [three,] two, or one of them, to call for Papers and examine
the Parties upon Oath.—

Functions of the
Commissioners. —

Sect.7. Functions of the Commissioners —

1st. As to lot A to settle the share of each Party in the Purchase Money —

2ly To lay out each share in the purchase of other Land or otherwise
(determining whether the shares: of the other PartiesUnited Parishes shall be held
independently of, or under, the Dean and Chapter) and in the
mean time in the Purchase of Government Securities.—

3ly. As to Lot B, to determine whether any and what satisfaction
to be made by the Dean and Chapter in respect thereof, to the
United Parishes, [and the Rector of St. Johns.]

4ly. As to Lot C. 1st. To allott the Land for the new Almshouse
2ly.. [To allott the Rector of St John's Share of this Part in the law of
the Tythes — 3ly] To determine as between the Dean and Chapter
and the united Parishes, which part, if any, of this Lot shall
respectively be allotted to them in kind — whether the Parishes shall
hold their part, if any, under, or independently of, the Dean and
Chapter — whether the share allotted to either shall be subjected to a
Lease or rent-charge for the benefit of the other — whether either
Party shall receive any compensation Money from the other — and
if so how the compensation Money shall be laid out.[1] [1]

Note

[1] The Powers given to the Commissioners in this behalf are made
as comprehensive as possible, for the purpose of affording them every
possible Facility for meeting wishes of the Parties, according to the
Quantity of legal Interest which they may be found respectively to
Possess. It has been understood that the Parishes wish for Land
whereon to build a new Poor House. The allotment above made
of their a part of the Land instead of its being added to the Spots designed for
the purpose of the Penitentiary Establishment, had principally in
view the meeting of that wish. —
