A Bill for explaining and amending
an Act made in the thirty fourth year of his present Majesty
intitled "An Act for erecting a Penitentiary House or Houses
"for confining and employing Convicts."

Preamble 34th. Geo.3
recited

Whereas by the Act made on the 7th Day of July 1794 in the thirty fourth
Year of the Reign of his present Majesty intitled "An Act for erecting a penitentiary
House of Houses for confining and employing Convicts"— Power is given to the
Lord High Treasurer or Commissioners of the Treasury for the time being to cause to
be erected a Penitentiary House or Penitentiary Houses for the purpose of confining
and employing transportable and other Convicts and for that purpose to fix either upon
a Spot composed of certain pieces of Ground therein mentioned and containing as therein
expressed 79a.C12. or upon any other as proper and convenient Spot of Ground
situate within any one or more of the Counties of Middlesex Kent Essex and Surrey
and to appoint a Feoffee or Feoffees for the purpose of purchasing and holding in
perpetual Succession such Spot as should be fixed upon, with Powers to enter upon
and take Possession of such Spot either on Conveyance made thereof from the owner or
owners (who for that purpose were thereby enabled to make such Conveyance: all
manner of disabilities notwithstanding) or in default of such Conveyance on Payment
of a sufficient sum of Money as and for the Purchase Money the Quantum whereof in case
of disagreement to be ascertained by a Verdict of a Jury, compensation being also in the
said Act provided for Tythe owners and Tenants in satisfaction for the respective
Interest.


And whereas no Ground hath been purchased for the purposes of the said Act.

And whereas a waste Spot consisting of 56 Acres are thereabout known by the
name of Tothill Fields in the Parishes of St. MArgaret and St. John in the City
