§.34 IIIIV. Partition of property in other shapes impossible

All properties that have All rights of property that

mass of bodily matter — a really existing entity — in any shape
have for their subject matter either something that came
under the head of immoveables, or something that
comes under the head of immoveables : and of what would
become of them becomes of matter in both shap these shapes, under the operation of the universal partition system, has already some conception has been already given.

If there be any

If there be any such thing as property in
any other shape, [+]1 it must still have for its immediate ultimate subject matter [+] if it possess any
value,

some portion of a portion of matter immoveable or moveable or both
a sort together, and at the same time for its immediate subject matter purely a sort of thing, which is no better other than a fictitious entity

Property then which, he, if according to the form given to assumed by this
part of the language, has for its immediate or nominal
subject matter a fictitious entity, must have for its original
and ultimate subject matter an a real entity
or aggregate of real entities, immoveable, moveable
or both: for man can neither inhabit a word
nor be fed or cloathed with one

Not to spend time and patience in any such dull
taste as that of giving an enumeration of the several
fictitious subject-matters of property that has received
their nominal existence, either from necessity or from
the sinister ingenuity of the English lawyers, let us take
at once in hand at and once, as a representative and substitute for all the rest that species, in comparison of which all others
stand put together shrink into insignificance.
