Punishment analysed into its various possible Modes
staying in or going out of a district and that district be very small
in comparison of the place which is left open to him, his punishment
is of a kind for which I can find no name in use. It
may be called Quasi-Imprisonment: his condition although effected
by different means being the same as if were in a prison

want of some such exhaustive view that an omission happened not
many years ago in a Statute of the British Parliament which it
took up another of no small magnitude to supply. By the Statute
23 Geo.II C.26. §. 11. It had been provided that persons against
whom a Justice's Warrant has been issued in one County,
may upon their going into another County be apprehended upon
the same Warrant endorsed by a Justice of such other County.
But it might happen that a man had been all along in a County
different from that in which the Warrant was granted, so
that he might never have gone into it. This had not occurred
to the Penner of the Act of Parliament. It became necessary therefor
once more to put that unwieldy boy in motion in order
to make a fresh Act (24. Geo. II. Ch. 55.) the effect of which was neither more nor up than to put the
