§. 1. Rebellion offensive
The distinction is not a merely verbal one. It
has for its ground a view taken a consideration of the difference in
respect of natural effect, and has a view to correspondent
legislative practice. By temporary usurpation
or a course of endeavours directed avowedly
or manifestly to that end, the one of the
second order, whatsoever may have been the case
with regard to the evil of the first order, receives
an indeterminate and boundless extent.
The sense of insecurity pervades
1. The whole of the existing official establishment, together
with persons and properties of the individuals,
whose conduct and affections are or are
supposed to be on the opposite side to an indefinite
amount: whereas in the case of rebellion
offensive, as above described, everyone understands,
that when the rebelling party has gained
its object, whatsoever be that object, it will
depend upon government to come to a compromise
and thereupon the rebellion with whatsoever
may be its accompanying evils will cease.
