<p>One disadvantage in this<lb/>
to Judge &amp; Co.&#x2014;viz. by stopping<lb/>
the fees. Purge swallowed<lb/>
suit is at an end&#x2014;no arguments<lb/>
&#x2014;judge not able<lb/>
to set at naught verdict of<lb/>
Jury.</p>
<p>In time this process found<lb/>
not so productive as others.<lb/>
Non lawyers w<hi rend="superscript">d</hi> have had it<lb/>
the same as in any other action.<lb/>
Here no lie &amp; no justice<lb/>
without&#x2014;(as no dancing without<lb/>
<gap/> &amp;c.) So Plaintiff<lb/>
must say that Defendant<lb/>
<hi rend="underline">found</hi> it, <sic>altho'</sic> proved that<lb/>
it was <hi rend="underline">delivered</hi> to him.</p>
<p>Suppose those times you<lb/>
bring your action. Cupidus<lb/>
hires 12 men: he &amp; they kiss<lb/>
a book &amp; mutter something.<lb/>
Jury must believe what an<lb/>
equal number have muttered.<lb/>
Cupidus has the horse without<lb/>
paying for it.</p>
<p>If perjury prosecutable<lb/>
at Common Law then, not<lb/>
worth enquiring. If yes, Cupidus<lb/>
would keep the horse<lb/>
and you if successful w<hi rend="superscript">d</hi><lb/>
have the satisfaction of knowing<lb/>
that <sic>thro'</sic> the powers of<lb/>
Judge over God&#x2014;that Cupidus<lb/>
would be in torments to eternity.</p>
