Every new tribunal created for the decision of facts,
without the intervention of a jury (whether composed
of Justices of Peace Commissioners of the
revenue, Judges of a Court of convenience, or any
other standing magistrates) is a step towards
establishing aristocracy, [the most oppressive of
absolute governments.] Yes: or rather a continuance
of an a system either aristocratical or
badly - monarchical or both, already established:
so long as provided that, like the class of magistrates exemplified adduced in example
they are out of the dependence of the people.
Thus a step towards establishing aristocracy? What?
if removeable at the pleasure of the people?
That however was a circumstance his conception
could not stretch to: what he saw that he would
conceive; but his conception could stretch no farther
