To compleat this application of the institution
to the system of judicature I propose it for,
the several things operations are wanting which
I must leave unperformed.
One is the establis sketching out an establishment
of a conclave in any Court for the incarceration annexed to every Justice-Hall of the
Jury which the trial is depending. For the
French who have been used know what Justice is and to see every cause
to the bottom will not be contented to see
a cause it tried by halves as the English are. A trial
before a Jury must therefore frequently be the
work of several days. they must there fore in
be lodged and boarded during the trial, that
they may be secluded from all corruptive
converse, intercourse or they must be let out to lodge and
board at their own houses: but if they are in this latter
case they are no Jury. I must confess I have
not courage to venture upon a task so laborious
and upon the face of it so absurd without some
better assurance that it is possible I can have
at present of its not being time and paper
thrown away. Yet in spite of the expense and
