The Court might have a power to pardon a witness
in order to command from him an evidence that
otherwise would make him accuse himself —
Man, to guard this against introducing a
general power of pardoning in the Ridges by fiction & contrivance
or at least to answer calm the apprehension of others that
such a power might in this manner spring up.
The reason does not hold good in written testimony,
which if it appears that a man has, he may
be compelled sine conditioni to produce - for him there
is no danger of Perjury — yet this has been refused + + v. in 1. Wils. 24.
