1. Grade (a) Ought not a Judge to be restrained from standing
in any election against one under whom
he had served in the station of Judge-Depute?
Reasons pro for the restraint — Jealousy might dissuade
a man Judge from choosing for his co-adjutor
a man of talents superior or even equal to his
own. Objection. There seems scarcely room for
jealousy. What security would it be to one this precaution give
man to take a man inferior to himself him, when
besides that one man there may be such so
a multitude of many other competitors in whose the choice of
whom he can have no influence? Reply. Answer. The
comparison will strike much more forcibly between
two men who are constantly serving in the
same place, than between any two who are at
a distance. And as the same ground for jealousy
applies equally to all, there would be a
sort of tacit convention among the order of
principal Judges to keep down the breed order of
Judges Depute. Rejoinder. Reply. The responsibility of
the principal for his co-adjutor renders it altogether
unsafe to him to appoint a person deputy who is
not really equal to the business: that being the case
the great necessary object is secured, and it seems too great a
