16 1. In all cases, at all times, it is the duty of the legislator, business of the law, and
under him of the Judge, to take care of all men: of all human beings
subject to his power. Therefore, wheresoever, at the suit of any one
creditor, appearance of insolvency manifests itself, arrangements
ought to be taken for extending the relief the benefit of the remedy and in the event of ultimate
insolvency, the burthen of loss, to all persons possessing the like standing in the
like relation to the defaulter claims on the defe supposed insolvent and his estate.
