Art.13. If, on pretence of its being an act of usurption
in respect of the powers of the government of the foreign country
in which such examination is designed to take place
if in this pretence or otherwise any endeavours are is in
by the intended examinee employed to prevent or frustrate
the re-examination, it will be received as circumstantial
evidence of evil consciousness on his part, and may
if the fact be sufficiently established be received and
employed as an adequate ground for a provisional
decree in favour of the pursuers demand. (v)
