Question 1
If by Consent (if it be free and fairly obtained) is made admitted as a ground of justification?
Reasons
1. Because it shews that the act was not mischevious
upon the whole: (See the next question:) As in which case and that accordingly
punishment would be groundless. See Introd.

Question II
Why consent must be free to serve as a
ground of justification?
Reasons
1. Because if not free, the reason for admitting
of it fails. When a man consent you consentfreely to submit a mode of treatment that a man shall by you in such or such a manner
to an act which in some cases might
be disagreeable to him you, it is a sign that from either
from his dealing with you in that manner is
productive of immediate satisfaction to you, or at least
that in the long run it is produtive of a satisfaction the same man either by means of such dealing
either or in some other manner is a means of producing you a satisfaction
greater than the inconvenience if any which such
behaviour of his was a means of producing to you
at first. But A greater ultimate good was therefore
